A importância da conduta ética nos precedentes judiciais.
Esta pesquisa objetiva uma
abordagem sobre a peça de Anjo Negro escrita
por Nelson Rodrigues em 1946 e encenada
pela primeira vez em 1948 no Rio de Janeiro.
Esta dramaturgia Rodriguiana retrata os
personagens desprovidos de julgamentos
sociais na peça, onde se encontram no estado
animalesco, favorecendo apenas seus instintos
naturais. Tem-se facilidade em dialogar a trama
com questões ligadas ao direito apontando de
forma objetiva o assassinato, estupro, incesto
entre outros que são abrangidos no código
penal brasileiro. RODRIGUES escreveu esta
dramaturgia anunciando aspectos menos
nobres do caráter humano, apontando
questões problemáticas, que na sociedade
contemporânea sofreriam ações jurídicas
conforme a lei, punitivamente. As peças de
modo geral do dramaturgo são imbuídas de
críticas e sátiras à sociedade, colocando em
reflexão os problemas de comportamentos
sociais. Anjo Negro encontram-se o infanticídio,
o incesto, o preconceito racial, o adultério,
o assassinato, o estupro entre outros. Tudo
isso é colocado de forma inteligente e
estranhamente desagradável, típica de Nelson
Rodrigues. A forma como são retratados os
personagens não foge de alguns conceitos
da psicologia e da psicanálise usados para se
tentar entender a subjetividade humana. Assim
pode se estabelecer relações entre a peça e
esses conceitos elaborados, por exemplo, os
de Sigmund Freud e Robert Zajonc, ambos
estudiosos da área entre outros. Depara-se
também com questões apresentada do âmbito
do direito. A questão do negro no Brasil, que pode
ser vista ainda nos dias atuais, o preconceito
racial dado pelo fenótipo ou sobre a trajetória
dessa raça, contudo a trajetória no Brasil. Ainda
o homicídio, que é dado pelo personagem
Ismael contra seu irmão de criação Elias; não
só desse caso, mas também de Virgínia esposa
de Ismael que mata seus três filhos, além de
ser homicídio, pode ser chamado de infanticídio
devido às idades dos filhos. Dentro do curso
de direito estamos em constante contato com
as variantes do ser humano, aliás, estudase
a construção do pensamento, as ações
que ele prática da qual a sociedade implica
consequências para manter o bem estar de
todos. Visa-se também o equilíbrio social, e
igualdade para todos os cidadãos, onde ele
possui deveres e direitos, dos quais difere da
peça de Anjo Negro. A arte, principalmente o
teatro de tragédia possui caráter identificador,
que faz com o que o público sinta como numa

espécie de “transe” as mesmas sensações dos personagens, fazendo que muitas
vezes houvesse a identificação do público com a peça; assim podemos ver que o ser
humano se compadece, revigorando seus próprios meios de pensar a humanidade,
assim hipoteticamente elencando a probabilidade de unir duas áreas das humanas
para proporcionar reflexão social, de forma que cada uma contemple suas categorias.

Abstract:
This research aims at an approach to the piece of Black Angel written by
Nelson Rodrigues in 1946 and first staged in 1948 in Rio de Janeiro. This Rodriguiana
dramaturgy portrays the characters devoid of social judgments in the play, where they
are in the animal state, favoring only their natural instincts. It is easy to dialogue the
plot with issues related to law pointing objectively to murder, rape, incest among others
that are covered in the Brazilian penal code. RODRIGUES wrote this dramaturgy
announcing less noble aspects of human character, pointing out problematic issues,
which in contemporary society would suffer juridical actions according to the law,
punitively. The plays of the playwright in general are imbued with criticisms and satires
to society, reflecting the problems of social behavior. Black Angel are infanticide,
incest, racial prejudice, adultery, murder, rape, among others. All this is intelligently
and strangely unpleasant, typical of Nelson Rodrigues. The way the characters are
portrayed does not escape some concepts of psychology and psychoanalysis used to
try to understand human subjectivity. Thus relations can be established between the
piece and these elaborate concepts, for example those of Sigmund Freud and Robert
Zajonc, both scholars of the area among others. There are also issues raised from
the scope of law. The black question in Brazil, which can still be seen in the present
day, the racial prejudice given by the phenotype or the trajectory of this race, but the
trajectory in Brazil. Still the homicide, which is given by the character Ismael against
his breeding brother Elias; not only of this case but also of Ismael’s wife Virginia who
kills her three children, in addition to being murder, may be called infanticide due to the
children’s ages. Within the course of law we are in constant contact with the variants
of the human being, by the way, we study the construction of thought, the actions that
he practice of which society entails consequences to maintain the well-being of all. It
also aims at social balance, and equality for all citizens, where it has duties and rights,
which differs from the play of Black Angel. The art, especially the theater of tragedy has
an identifiable character, which makes the public feel as if in a kind of “trance” the same
sensations of the characters, causing that many times there was the identification of the
public with the play; so we can see that the human being pities himself, reinvigorating
his own ways of thinking humanity, thus hypothetically listing the probability of uniting
two areas of human beings to provide social reflection, so that each one contemplate
their categories.
