A HERANÇA PRESERVACIONISTA PRESENTE NAS LEGISLAÇÕES AMBIENTAIS E SUAS CONSEQUÊNCIAS PARA COMUNIDADES TRADICIONAIS EM UNIDADES DE CONSERVAÇÃO DE PROTEÇÃO INTEGRAL
Devido à sobreposição de legislações
que visam a conservação da natureza, conflitos
ambientais são inerentes à gestão de Unidades
de Conservação, sobretudo nas categorizadas
como Proteção Integral. Apresente pesquisa teve
como objetivo propor uma reflexão a respeito
dos conflitos entre a Comunidade Tradicional
do Morro das Andorinhas e o Parque Estadual
Serra da Tiririca (PESET), situados em Niterói –
RJ, a partir de entrevista semiestruturada com
“informante único”, morador mais antigo da
comunidade. Fundamentado no diálogo com a
agroecologia no âmbito do manejo sustentável
das práticas tradicionais, buscamos destacar o
desamparo de algumas legislações ambientais
em relação às comunidades tradicionais,
contrariando políticas de legitimação de
identidade de povos e até mesmo a Constituição
Federal de 1988. Fornecendo subsídio para
diversas interpretações da relação homemnatureza
nesse espaço de ancestralidade e
conservação.

Abstract:
Due to overlapping laws that aim
at nature conservation, environmental conflicts
are inherent to the management of Conservation
Units, especially those categorized as Integral
Protection. This research aimed to propose a
reflection on the conflicts between the Traditional
Community of the Andorinhas Hill and the Serra
da Tiririca State Park (PESET), located in
Niterói - RJ, from a semi - structured interview
with a single informant, community. Based on
the dialogue with agroecology in the field of
sustainable management of traditional practices,
we sought to highlight the abandonment of
some environmental legislation in relation to
traditional communities, contradicting policies
to legitimize the identity of peoples and even
the Federal Constitution of 1988. Providing
subsidy for several interpretations of the mannature
relationship in this space of ancestry and
conservation.
