A FUNDAMENTAÇÃO DAS DECISÕES JUDICIAIS COMO UM DOS DIREITOS HUMANOS
O artigo aborda os Direitos Fundamentais em comparação e, ao mesmo tempo, distinção com os Direitos Humanos para, em seguida, analisar o direito das partes, envolvidas em um processo judicial, de terem fundamentadas as decisões lá tomadas, pelo julgador. Assim, estuda-se a fundamentação das decisões judiciais, bem como o ato mental da motivação. Conjugando os artigos 93, IX da Constituição Federal e 489, §1º e 1.022 do Código de Processo Civil, bem como analisando julgados das cortes internacionais de Direitos Humanos, chegou-se à conclusão de que a fundamentação das decisões judiciais, para além de um Direito Fundamental, pode ser considerada como um dos Direitos Humanos.

Abstract:
The article deals with Fundamental Rights in comparison and, at the same time, distinction with Human Rights, to then analyze the right of the parties, involved in a judicial process, to have reasoned the decisions made there, by the judge. Thus, the reasoning of judicial decisions is studied, as well as the mental act of motivation. Combining articles 93, IX of the Federal Constitution of Brazil and 489, §1 and 1.022 of the Brazilian Code of Civil Procedure, as well as analyzing judgments of international human rights courts, it was concluded that the reasoning of judicial decisions, more than a Fundamental Right, can be considered as one of the Human Rights.
