A FUNÇÃO SOCIAL E A DESAPROPRIAÇÃO POR UTILIDADE PÚBLICA: A RELAÇÃO ENTRE INTERESSE COLETIVO E INDIVIDUAL
O trabalho objetiva verificar se a desapropriação por utilidade pública realizada no Brasil, sobre o argumento do interesse coletivo acima do individual, cumpre com a função social da propriedade. Para responder ao questionamento, por meio de entendimentos doutrinários, primeiramente analisar-se-á a história e o conceito de função social da propriedade, em um segundo momento, verificar-se-á como as desapropriações por utilidade pública são realizadas no Brasil, trazendo como exemplo, as obras da Copa do Mundo de 2014, e os impasses que ainda existem anos depois. Por fim, conclui-se que a desapropriação baseada na utilidade pública deve seguir o princípio da função social da propriedade, porém este princípio precisa ser interpretado além do fundamento da supremacia do interesse público, devendo proteger não só o interesse coletivo, mas também proteger o interesse dos indivíduos que tiveram suas propriedades desapropriadas.

Abstract:
The work aims to verify if the expropriation for public utility carried out in Brazil, on the argument of collective interest over the individual, fulfills the social function of property. To answer the question, through doctrinal understandings, firstly, the history and concept of the social function of property will be analyzed, in a second moment, it will be verified how expropriations for public utility are carried out in Brazil, bringing as an example, the works of the 2014 World Cup and the impasses that still persist years later. Finally, it is concluded that expropriation based on public utility must follow the principle of the social function of property, but this principle needs to be interpreted beyond the foundation of the supremacy of public interest, and must protect not only the collective interest, but also protect the interest of individuals who had their properties expropriated.
