A FIDELIDADE RECÍPROCA DOS CÔNJUGES E A POSSIBILIDADE DE CABIMENTO DA CLÁUSULA INDENIZATÓRIA POR TRAIÇÃO, NO PACTO ANTENUPCIAL
Será estudado a seguir os aspetos do casamento e da união estável, as obrigações do casamento como a fidelidade recíproca e a vida em comum no domicílio conjugal, e se podem ser elencadas no pacto antenupcial. A problemática se deu após ampla discussão sobre o tema da fidelidade recíproca, se pode ser elencada no pacto antenupcial, e sua divergência doutrinária, que diz se é cabível haver uma cláusula do tipo, e se a lei permite tal cláusula no pacto antenupcial. A regulamentação da fidelidade recíproca, vem como modo de punir o cônjuge que descumpra tal obrigação, indenizando o cônjuge traído, já a obrigação de dever de vida em comum, não pode ser elencada visando permitir que os cônjuges vivam separados. O tema justifica-se por estar tomando força e notoriedade somente agora, após vários casos repercutirem na mídia. Com o estudo do tema conclui-se que se pôr vontade de ambos os cônjuges ou companheiros, poderá ser elencada cláusula indenizatória em caso de traição, além de ser permitido eles escolherem o regime de bens, além de estipular outras condições para a melhor convivência conjugal. A metodologia utilizada no presente artigo, constou-se do método dedutivo, utilizando-se bibliografia, artigos de internet e uso de casos.

Abstract:
The aspects of marriage and stable union, the obligations of marriage such as reciprocal fidelity and life in common in the marital home, will be studied below, and whether they can be listed in the prenuptial agreement. The problem occurred after extensive discussion on the topic of reciprocal fidelity, whether it can be listed in the prenuptial pact, and its doctrinal divergence, which says whether a clause of the type is appropriate, and whether the law allows such a clause in the prenuptial pact. The regulation of reciprocal fidelity, comes as a way to punish the spouse who breaches such obligation, indemnifying the betrayed spouse, since the obligation of common duty of life, cannot be listed aiming to allow the spouses to live separately. The theme is justified for being gaining momentum and notoriety only now, after several cases had repercussions in the media. With the study of the theme, it is concluded that if the will of both spouses or partners is put, an indemnity clause may be listed in case of betrayal, in addition to being allowed to choose the property regime, in addition to stipulating other conditions for better marital coexistence. The methodology used in the present article, consisted of the deductive method, using bibliography, internet articles and use of cases.
