Abstract: This article examines the extent of jurisdiction and subject-matter jurisdiction in rescissory actions, highlighting the functional distinction between the iudicium rescindens and the iudicium rescissorium. It demonstrates that, although successive, these judgments are not interdependent, varying according to the legal basis of Article 966 of the Code of Civil Procedure (CPC). The research utilizes a deductive method and a dogmatic approach, incorporating legislative analysis, historical reconstruction, and an examination of precedents from the Superior Court of Justice (STJ). The results demonstrate the sui generis nature of the admissibility ruling, the deconstructive character of the rescindent ruling, and the conditional occurrence of the rescissory ruling, limited to cases in which the defect permits a new trial within the limits of the original case.
