A EVOLUÇÃO NORMATIVA REFERENTE A TUTELA DOS DIREITOS INDÍGENAS E SUA CONCRETIZAÇÃO POR MEIO DA LEGITIMIDADE NO PROCESSO COLETIVO
O presente trabalho visa abordar a
evolução normativa no que tange a tutela dos
povos indígenas brasileiros em sua história.
Traçando uma linha cronológica, este artigo
busca trazer uma comparação que parte
das principais caraterísticas da legislação
colonial relativa aos indígenas, ao passar
pelo surgimento de suas primeiras instituições
representativas, até a sua real efetivação por
meio da Carta Magna de 1988, símbolo maior
da concretização e do reconhecimento dos
direitos dos referidos povos. Além, de trazer
importantes informações sobre a legitimidade
das comunidades indígenas no viés atual do
processo coletivo.

Abstract:
The present work aims to
approach the normative evolution concerning
the protection of Brazilian native peoples in
their history. Building a timeline, this article
seeks to bring a comparison that starts with
the main characteristics of colonial legislation
refereeing to indigenous peoples, passing
through the appearance of its first representative
institutions, until its actual realization with the of
the magna letter of 1988, a greater symbol of the
realization and recognition of the rights of those.
Furthermore bringing important information
about the legitimacy of indigenous communities
in the current character of the collective process.
