A EVOLUÇÃO DO CONCEITO DE FAMÍLIA BRASILEIRA
O presente artigo visa discutir a
evolução da família brasileira definindo os
conceitos e buscando compreender como
se deu essa mudança no contexto social,
analisando as antigas e tradicionais formas de
família, os princípios basilares que norteavam
a noção jurídica do matrimônio. No contexto
jurídico, o direito deve acompanhar a sociedade
com suas novas formas de comportamento,
sendo a família brasileira a amostra mais fácil de
constatar-se esse fato, posto que a legislação
pátria, para se adequar ao contexto social
encontrado no mundo contemporâneo, sofreu e
sofre constantes mudanças sendo incorporados
novos conceitos, novos posicionamentos
perante os tribunais, sobre a nova forma de
constituição familiar; do contrário, o Direito se
tornará letra morta. Para tanto, será feita uma
pesquisa de caráter bibliográfico tendo como
marco teórico lei, doutrinas e jurisprudências.

Abstract:
This article aims to discuss
the evolution of the Brazilian family defining
the concepts and trying to understand how
this change in the social context occurred,
analyzing the old and traditional forms of
family, the basic principles that guided the legal
notion of marriage. In the legal context, law
must accompany society with its new forms of
behavior, the Brazilian family being the easiest
sample to verify this fact, since the national
legislation, to suit the social context found in the
contemporary world, suffered and undergoes
constant changes incorporating new concepts,
new positions before the courts, about the
new form of family constitution; otherwise, law will become a dead letter. To do so, a
bibliographic research will be carried out with theoretical framework law, doctrines and
jurisprudence.
