A equidade de Rawls e a igualdade de Amartya Sen: justiça distributiva e proteção de direitos fundamentais
John Rawls (1921-2002) foi
um grande autor da filosofia política, que
por meio suas obras, influenciou a forma
de se discutir a justiça distributiva. Ocorre
que diversos autores, como Amartya Sen,
apontaram falhas em sua teoria com vistas a
assegurar a igualdade fática. Nesse sentido,
este artigo aborda os direitos fundamentais
sob a ótica da teoria da justiça como equidade
de Rawls, complementada pela igualdade de
capacidades de Amartya Sen. O objetivo é
analisar como estas teorias liberais contribuem
para a discussão da justiça distributiva e para
a proteção de direitos fundamentais. Utilizouse
de uma abordagem de natureza teórica e,
como procedimento metodológico, de pesquisa
bibliográfica, documental e descritiva. Diante do
quadro apresentado, constata-se que a justiça
liberal concebe a justiça distributiva dentro de
limites.

Abstract:
John Rawls (1921-2002) was a
great author of political philosophy, who through
his works, influenced the way to discuss
distributive justice. It occurs that several authors,
such as Amartya Sen, pointed out flaws in his
theory with a view to ensuring phatic equality.
In this sense, this article deals with fundamental
rights from the point of view of the theory of
justice as fairness of Rawls, complemented by
the equality of capacities of Amartya Sen. The
objective is to analyze how these liberal theories
contribute to the discussion of distributive
justice and to the protection of fundamental
rights. An approach of a theoretical nature and,
as methodological procedure, of bibliographic,
documentary and descriptive research was
used. In view of the table presented, it is noted
that the liberal justice conceives of distributive
justice within limits.
