A EDUCAÇÃO COMO INSTRUMENTO DE GOVERNANÇA PARA CAPACITAR OS INTERVENTORES HUMANOS NA APLICAÇÃO E REGULAÇÃO DA INTELIGÊNCIA ARTIFICIAL NO PODER JUDICIÁRIO BRASILEIRO
Benoit Frydman, em seu livro o “O fim do Estado de Direito - governar por standards e indicadores” demonstra que normas técnicas e de gestão (dispositivos de avaliação e de controle) tornaram-se instrumentos atuais de pilotagem do próprio Direito, o que o autor denomina de pilotagem dos Estados por indicadores, destacando a facilidade com que estes instrumentos produzem efeitos regulatórios potencialmente importantes. O uso de inovações tecnológicas e IA já são uma realidade no Poder Judiciário, e o Conselho Nacional de Justiça tem se mostrado preocupado com sua regulação. Assim, o presente artigo visa demonstrar que a academia será um dos principais atores na capacitação dos interventores humanos que atuarão diretamente no uso e aplicação destas tecnologias, colaborando, inclusive, na criação de regulamentações, afastando-se, desta forma, a probabilidade de se “pilotar” o Poder Judiciário.

Abstract:
Benoit Frydman, in his book “The end of the Rule of Law - governing by standards and indicators” demonstrates that technical and management norms (evaluation and control devices) have become current instruments of piloting the Law itself, which the author calls states' piloting by indicators, highlighting the ease with which these instruments produce potentially important regulatory effects. The use of technological innovations and AI are already a reality in the Judiciary, and the National Council of Justice has been concerned with its regulation. Thus, the present article aims to demonstrate that the academy will be one of the main actors in the training of human interventions that will act directly in the use and application of these technologies, even collaborating in the creation of regulations, thus moving away from the probability of “Pilot” the Judiciary.
