A DUALIDADE E CONTRAPONTOS ENTRE O DIREITO PENAL E A INTELIGÊNCIA ARTIFICIAL
O presente estudo tem por objeto a contextualização das novas tecnologias presentes no mundo moderno e de seu controle, mormente pelo mecanismo estatal punitivo e retributivo do Direito Penal, frente às novas tecnologias existentes em todo o mundo, tendo como grande centro, a Inteligência Artificial (I.A).
Busca-se compreender quais os impactos da Inteligência Artificial, aliando-se aos sistemas penais da atualidade, com ênfase no direito penal e processual penal brasileiro, diante da nova onda tecnológica, o tratamento de dados sensíveis por trás da mesma e todos os possíveis mecanismos de controle tecnológicos que as novas tecnologias proporcionam.
Utilizando-se do método indutivo, buscar-se-á examinar, desta forma, os efeitos e promover a análise dos referidos textos legais, em consonância com o que acontece no mundo digital, em todo o planeta terra, concomitantemente, principalmente, no âmbito jurídico, sobretudo, diante do recentes casos envolvendo a Inteligência Artificial e as possíveis responsabilizações penais advindas dessa dualidade.

Abstract:
The present study aims to contextualize the new technologies present in the modern world and their control, especially through the punitive and retributive state mechanism of Criminal Law, in face of the new technologies existing worldwide, with Artificial Intelligence as the main center (A.I).
It seeks to understand the impacts of Artificial Intelligence, allying itself with the current criminal systems, with an emphasis on Brazilian criminal law and criminal procedure, in the face of the new technological wave, the processing of sensitive data behind it and all possible mechanisms technological control systems that new technologies provide.
Using the inductive method, we will try to examine, in this way, the effects and promote the analysis of the referred legal texts, in line with what happens in the digital world, in the whole planet earth, concomitantly, mainly, in the scope especially in view of the recent cases involving Artificial Intelligence and the possible criminal liability arising from this duality.
