A DISCRIMINAÇÃO JURÍDICA NA APLICAÇÃO DAS LEIS NO PROCESSO PENAL BRASILEIRO, ASSIM COMO NA OBTENÇÃO DOS BENEFÍCIOS DA LEI 7.210 DE 11 DE JULHO DE 1984 – LEI DE EXECUÇÕES PENAIS.
Para diminuir o incômodo causado
pelas decisões judiciais polêmicas, com maior
ênfase na aplicação da pena na esfera criminal,
em especial com respeito a diversidade de
entendimento dos argumentos demonstrados
pelo judiciário brasileiro, é preciso fazer um
retrospecto para demonstrar que a discriminação
na aplicação da lei penal não é de hoje, onde,
através da busca do passado, pode-se retirar
lições para que sua aplicação no futuro seja mais
justa, equânime e democrática. Este artigo tem
por objetivo tecer algumas considerações sobre
a aplicabilidade da lei penal, demonstrando que
a discriminação na sua aplicação torna a justiça
injusta, fugindo do pensamento aristotélico da
justa pena.

Abstract:
To reduce the discomfort caused
by controversial judicial decisions, with a
greater emphasis on the application of criminal
penalties, especially with respect to the diversity
of understanding of the arguments presented
by the Brazilian judiciary, a retrospective is
necessary to demonstrate that discrimination
in law enforcement criminal law is not of today,
where, through the search of the past, lessons
can be learned so that its application in the future
is more just, equitable and democratic. This
article aims to make some considerations about
the applicability of criminal law, demonstrating
that discrimination in its application renders
justice unjust, escaping from the Aristotelian
thought of the just penalty.
