A DESCRIMINALIZAÇÃO DO ABORTO: UMA ANÁLISE À LUZ DOS DIREITOS HUMANOS
Diante da polêmica jurídica e social que envolve o aborto em todo o mundo, o presente trabalho tem por objetivo analisar a descriminalização do abortamento na perspectiva dos direitos humanos, bem como à luz dos argumentos dos grupos pró-vida e pró-aborto. O Código Penal brasileiro, ao menos ainda, não legaliza o aborto, salvo algumas excepcionalidades. Porém, há constante discussão sobre o assunto, tendo em vista que os países mais desenvolvidos, majoritariamente, descriminalizam a prática e vêm obtendo resultados positivos. Além disso, há apresentação de dados quantitativos e comparativos acerca do abortamento no mundo, assim como o impacto provocado pela demonstração desses dados e o apoio internacional expressivo em favor dos direitos fundamentais das mulheres. A temática mostra-se relevante, pois promove a compreensão dos motivos e justificativas que consubstanciam as posições favoráveis e desfavoráveis à descriminalização do aborto. Sendo assim, corrobora-se no impasse, ainda impossibilitado de decisão conclusiva, sobre a legalização ou permanência da criminalização do aborto no Brasil, mesmo com o conhecimento das estatísticas positivas dos países desenvolvidos, onde o aborto se tornou uma prática legal. Então, admitindo exclusivamente os dados internacionais, o Brasil tenderia à legalização do aborto, porém, os paradigmas culturais e religiosos do país não corroboram com essa decisão. O artigo, quanto ao método de abordagem, operou-se a partir do hipotético-dedutivo, amparando-se em análises bibliográficas e documentais, ressaltando aspectos históricos e comparativos, quanto ao procedimento.

Abstract:
In view of the legal and social controversy surrounding abortion worldwide, the present work aims to analyze the decriminalization of abortion from the perspective of human rights, as well as in the light of the arguments of pro-life and pro-abortion groups. The Brazilian Penal Code, at least still, does not legalize abortion, except for some exceptionalities. However, there is constant discussion on the subject, considering that the most developed countries, mostly, decriminalize the practice and have been obtaining positive results. In addition, there is the presentation of quantitative and comparative data on abortion in the world, as well as the impact caused by the demonstration of these data and significant international support in favor of women's fundamental rights. The theme is relevant because it promotes the understanding of the reasons and justifications that constitute the favorable and unfavorable positions to the decriminalization of abortion. Thus, it is corroborated in the impasse, still impossible to conclude, on the legalization or permanence of the criminalization of abortion in Brazil, even with the knowledge of the positive statistics of developed countries, where abortion has become a legal practice. Thus, assuming exclusively the international data, Brazil would tend to legalize abortion, however, the cultural and religious paradigms of the country do not corroborate this decision. The article, regarding the method of approach, operated from the hypothetical-deductive, based on bibliographic and documentary analyses, highlighting historical and comparative aspects regarding the procedure.
