A CONSAGRAÇÃO DA IDENTIDADE DE GÊNERO NO ORDENAMENTO JURÍDICO COMO DILEMA ATUAL DOS DIREITOS FUNDAMENTAIS
Os direitos fundamentais estão positivados na Constituição Federal de 1988 sob o Capítulo I inserido no Título II. Entretanto, não basta que os direitos fundamentais constem no texto constitucional, se faz imperativo que eles sejam efetivamente assegurados no ordenamento jurídico brasileiro. Nesse contexto, os transexuais, cuja identidade de gênero não condiz com o sexo biológico, são capazes de direitos fundamentais referentes à personalidade que não lhe são devidamente resguardados. A utilização do método dedutivo, por meio da análise monográfica, legislativa e doutrinária, permite concluir que o Poder Judiciário ao fazer o papel do Poder Legislativo, o qual se mantém inerte nessa questão, possibilita a consagração da identidade de gênero e demais direitos dos transexuais no ordenamento jurídico por meio da jurisprudência.

Abstract:
The fundamental rights are affirmed in the Federal Contitution of 1988, under the Chapter I inside the Title II. However, it is not enough to have the fundamental rights just in the constitucional text, it is imperative to have them effectively ensured in the brazilian legal order. In such a context, the transsexual, whose gender identity does not follow the biological sex, are capable of fundamental rights related to the personality that are not appropriately ensured. Through the analyses of biographys, laws and doctrine, by using the deductive method, it is allowed to conclude that de Judiciary Branch when takes on the role of the Legislative Branch, which keeps na inert position on this matter, enables the gender identity and other transsexual rights consolidation in legal order throught the jurisprudence.
