A CONCRETIZAÇÃO DO DIREITO FUNDAMENTAL À SAÚDE MENTAL DA MULHER NO MEIO AMBIENTE DE TRABALHO: UMA ANÁLISE DE GÊNERO E JURISPRUDENCIAL

A presente pesquisa tem por objetivo analisar como a jurisprudência dos tribunais trabalhistas brasileiros tem se posicionado, entre 2018 e 2023, em demandas ajuizadas por mulheres sobre saúde mental no ambiente de trabalho e em que medida essas decisões dialogam com os direitos fundamentais e com a realidade social marcada por desigualdades de gênero. O estudo aborda os direitos à saúde mental e ao meio ambiente de trabalho equilibrado como expressões da dignidade da pessoa humana, com ênfase nas condições enfrentadas pelas mulheres. Também discute a permanência da mulher no mercado de trabalho diante da divisão sexual do trabalho e da sobrecarga das múltiplas jornadas. Por fim, analisa decisões judiciais propostas exclusivamente por mulheres. Adotando o método materialista histórico-dialético, conclui-se que a atuação isolada da Justiça do Trabalho é insuficiente, sendo necessária a articulação de políticas públicas, fiscalização e ações institucionais para concretizar os direitos fundamentais no cotidiano laboral.

  • Abstract: This research aims to analyze how the jurisprudence of Brazilian labor courts has positioned itself, between 2018 and 2023, in lawsuits filed by women regarding mental health in the workplace and to what extent these decisions dialogue with fundamental rights and with the social reality marked by gender inequalities. The study addresses the rights to mental health and a balanced work environment as expressions of human dignity, with an emphasis on the conditions faced by women. It also discusses the permanence of women in the labor market in the face of the sexual division of labor and the overload of multiple shifts. Finally, it analyzes judicial decisions proposed exclusively by women. Adopting the historical-dialectical materialist method, it is concluded that the isolated action of the Labor Court is insufficient, requiring the articulation of public policies, oversight, and institutional actions to realize fundamental rights in daily work.
