Abstract: This research aims to analyze how the jurisprudence of Brazilian labor courts has positioned itself, between 2018 and 2023, in lawsuits filed by women regarding mental health in the workplace and to what extent these decisions dialogue with fundamental rights and with the social reality marked by gender inequalities. The study addresses the rights to mental health and a balanced work environment as expressions of human dignity, with an emphasis on the conditions faced by women. It also discusses the permanence of women in the labor market in the face of the sexual division of labor and the overload of multiple shifts. Finally, it analyzes judicial decisions proposed exclusively by women. Adopting the historical-dialectical materialist method, it is concluded that the isolated action of the Labor Court is insufficient, requiring the articulation of public policies, oversight, and institutional actions to realize fundamental rights in daily work.
