A AUDIÊNCIA PÚBLICA AMBIENTAL NO PARADIGMA DE ESTADO DEMOCRÁTICO DE DIREITO
Com a implementação formal do Estado Democrático de direito, em 1988, tornou-se necessário incorporar práticas de fiscalidade plena em todas as atuações estatais. Assim, por ser um procedimento administrativo, o licenciamento ambiental também deve contar com a participação popular. Foi realizado um recorte, focando na audiência pública e em duas de suas características, que aparentam ser obstáculos à participação popular. Portanto, discute-se se as adequações ao atual modelo de Estado foram adequadamente realizadas, ou se o instituto jurídico ainda carece de reformas democráticas. A pesquisa pertence à vertente metodológica jurídico-dogmática do tipo jurídico-descritivo, e predominará o raciocínio dialético.

Abstract:
With the formal implementation of the Democratic Rule of Law in 1988, full taxation practices into all state actions became necessary. As it is an administrative procedure, environmental licensing must also rely on popular participation. A cut was made, focusing on the public hearing and on two of its characteristics, which appear to be obstacles to popular participation. Therefore, it is discussed whether the adjustments to the current State model were properly carried out, or whether it still lacks democratic reforms. The research belongs to the legal-dogmatic methodological branch of the legal-descriptive type, and dialectical reasoning will predominate.
