A ATUAÇÃO DO ESTADO, ENQUANTO GARANTIDOR DE DIREITOS, DIANTE DA POPULAÇÃO EM SITUAÇÃO DE VULNERABILIDADE: AS ENCHENTES SAZONAIS DO MUNICÍPIO DE RIO BRANCO
A cada ano que passa o Município de
Rio Branco se depara com uma enchente, que
em alguns casos ocorrem de forma trágica,
desabrigando várias famílias e gerando,
em grande proporção, prejuízos tanto para
a população afetada quanto para o Poder
Público, que de forma eficaz ou não precisa
se responsabilizar pelo ocorrido. Por ser um
fato recorrente, este trabalho irá discutir por
qual motivo diversas famílias continuam a
serem afetadas pelas enchentes que ocorrem
sazonalmente na capital do Acre e quais as
ações que o poder público tem realizado para
minimizar ou extinguir os danos decorrentes
desse fenômeno natural. O objetivo geral deste
trabalho é discutir as políticas públicas de
habitação e sua efetividade na resolução dos
problemas relacionados às enchentes. Como
objetivos específicos têm-se de apresentar os
direitos e garantias fundamentais e observar
sua violação na ocasião das enchentes,
conceituar políticas públicas e descrever o
empreendimento habitacional Cidade do Povo.
Para tanto foi realizado uma revisão da literatura
através de livros, artigos, dissertações, leis e
outros documentos que pudessem fomentar o
arcabouço teórico desse trabalho. Conclui-se
que o poder público pouco tem contribuído para
extinguir esse problema e, durante os anos
apenas realizado ações paliativas e/ou pouco
efetivas pela não continuidade, como o caso da
Cidade do Povo.

Abstract:
Each year that passes the
Municipality of Rio Branco is facing a flood,
which in some cases occur in a tragic way,
displacing several families and generating, to
a great extent, damages for both the affected
population and the Public Power, which in a way
effective or not have to take responsibility for
what happened. As a recurring fact, this paper
will discuss why several families continue to
be affected by seasonal flooding in the capital
of Acre and what actions have been taken by
the government to minimize or extinguish the

damages caused by this natural phenomenon. The general objective of this work is to
discuss public housing policies and their effectiveness in solving problems related to
floods. As specific objectives have to present the fundamental rights and guarantees
and observe their violation in the occasion of the floods, conceptualize public policies
and describe the housing project Cidade do Povo. For that, a review of the literature
was carried out through books, articles, dissertations, laws and other documents that
could foster the theoretical framework of this work. It is concluded that the public power
has little contributed to extinguish this problem and during the years only carried out
palliative and / or ineffective actions for non-continuity, as in the case of Cidade do Povo.
