A ASSISTÊNCIA SOCIAL COMO POLÍTICA PÚBLICA E DEVER DO ESTADO PÓS-CONSTITUIÇÃO DE 1988
O artigo visa tratar do novo status
que a Assistência Social obteve a partir
entrada em vigor da Constituição Federal de
1988, quando esta passou a ser um dever do
Estado e direito do cidadão, figurando como
um direito social e compondo a seguridade
social. Não obstante, buscar-se-á enfatizar a
importância da Assistência Social ter passado
a ser um direito previsto constitucionalmente,
abrindo portas para que a mesma passasse a
ser regulamentada. Para tanto, este trabalho
se apóia em uma pesquisa qualitativa, ou seja,
em conhecimentos específicos a respeito da
matéria, fruto de pesquisa bibliográfica e de
normas aplicáveis ao assunto. Como resultado,
concluiu-se que os direitos sociais relativos à
assistência social estão sendo concretizados
de forma gradual, e sua implementação e
aperfeiçoamento ainda são desafios a serem
encarados pelo Estado e pela sociedade.

Abstract:
This article aims to discuss the
new status that social assistance obtained from
entry into force of the Constitution of 1988, when
it became a duty of the State and the citizen’s
right, appearing as a social right e making part
of the social security system. Nevertheless, this
article will seeks to emphasize the importance of
social assistance reached after being promoted
as a constitutional right. Therefore, this work is
based in a qualitative research, in other words,
by specific knowledge about the matter, product
of the applicable literature and legal provisions.
As result, it was concluded that the social rights
concerning the social assistance are being
gradually materialized, and its implementation
and improvement still challenges to be faced by the state and society.
