A AFETIVIDADE COMO PRINCÍPIO NO DIREITO DE FAMÍLIA
Na contemporaneidade tem-se a transformação da entidade familiar, em comparação aos conceitos formados ao longo da história da humanidade, onde o sentimento de afeto entre os indivíduos nas relações interpessoais é tido como imprescindível para a constituição de tal união, e também em certos casos a própria gênesis de tal elo. Não mais se sustenta que a família é formada por única e exclusivamente através do matrimônio. Não afastando os vínculos, registrais, a socioafetividade mostra-se como o principal elo constitutivo e formador das hodiernas relações familiares. Em razão desta evolução conceitual deve o direito acompanhar e tutelar tais vínculos. E assim é feito através dos princípios constitucionais. Posto isto, localizado no âmbito constitucional o princípio da afetividade rege o direito de família e as suas derivações.

Abstract:
In contemporary times one has the transformation of the family entity, in comparison to the concepts formed throughout the history of humanity, where the feeling of affection between the individuals in the interpersonal relations are considered as essential for the constitution of such union, and also in certain cases the very genesis of such a link. It no longer holds that the family is formed solely and exclusively through matrimony. Not separating the links, registis, socioaffectivity shows itself as the main constitutive and forming link of today's family relations. Because of this conceptual evolution the right to monitor and protect such links should be monitored. And so it is done through constitutional principles. Having said this, located within the constitutional scope, the principle of affectivity governs family law and its derivations
