A ADOÇÃO DE IDOSOS NO BRASIL – ANÁLISE À LUZ DE PROPOSTAS LEGISLATIVAS
Diante do crescente envelhecimento populacional e a ocorrência de abandono afetivo inverso, esse trabalho teve como objetivo verificar como se daria a adoção de idosos no Brasil, diante dos projetos de lei em tramitação no Congresso Nacional. Foi realizada pesquisa bibliográfica quali-quantitativa explicativa, utilizando doutrinas de Direito Civil e a legislação vigente. O método de abordagem utilizado para a pesquisa foi o dedutivo. O trabalho foi modelado com pesquisa sobre o princípio da solidariedade familiar, o cuidado do idoso e o instituto da adoção na forma legalmente estruturada no Brasil. Por fim, analisou-se os Projetos de Lei nº 956/2019, nº 5475/2019, nº 5532/2019 e nº 105/2020, que pretendem inserir a adoção de idosos no ordenamento jurídico nacional. Concluiu-se que as propostas legislativas em tramitação vão ao encontro da proteção constitucional da pessoa idosa, garantindo sua colocação em família substituta. Sobre as propostas analisadas, destaque ao PL nº 105/2020, que, apresentando um novo instituto jurídico chamado de senexão, possibilitaria a colocação do idoso em família substituta, prevendo de forma mais detalhada os desdobramentos e impactos de tal medida. Além disso, a criação de um instituto jurídico sui generis desvia das dificuldades geradas ao tentar adaptar um instituto já existente para uma finalidade diversa daquela para a qual foi criada.

Abstract:
Considering the aging growth of the population and the occurrence of inverse affective abandonment, this work aimed to verify how the adoption of elderly people in Brazil would take place, in view of the bills in progress in the National Congress. Explanatory quali-quantitative bibliographic research was carried out, using doctrines of Civil Law and the current legislation. The approach method used for the research was the deductive one. The work was modeled with research on the principle of family solidarity, the care of the elderly and the institute of adoption the way it is legally structured in Brazil. Finally, three bills were analyzed (No. 956/2019, No. 5475/2019, No. 5532/2019 and No. 105/2020), which intend to insert the adoption of the elderly into the national legal system. It was concluded that the legislative proposals in progress are in line with the constitutional protection of the elderly, guaranteeing their placement in a substitute family. Regarding the analyzed proposals, the work highlights Bill No. 105/2020, which, introducing a new legal institute called “senexão”, would enable the elderly to be placed in a substitute family, predicting in detail the consequences and impacts of such measure. In addition, the creation of a “sui generis” legal institute avoids the difficulties created by trying to adapt an existing institute for a purpose other than that for which it was created.
