Este artigo examina a conceitualização da regulação e a evolução de seu escopo por meio de uma revisão da literatura científica. Em seguida, analisa a emergência da regulação por meio de precedentes judiciais e relaciona esse fenômeno à crescente judicialização de disputas ambientais. Finalmente, com base em uma seleção limitada, porém representativa, de casos envolvendo danos ambientais reais e potenciais, compara esses casos a fim de identificar seus efeitos e consequências concretos para a sustentabilidade ambiental. Ao fazer isso, o artigo avalia o litígio ambiental como uma ferramenta regulatória emergente no médio e longo prazo.

  • Abstract: This article examines the conceptualization of regulation and the evolution of its scope through a review of scientific literature. It then analyzes the emergence of regulation through judicial precedents and relates this phenomenon to the growing judicialization of environmental disputes. Finally, drawing on a limited but representative selection of cases involving actual and potential environmental harm, it compares these cases in order to identify their concrete effects and consequences for environmental sustainability. In doing so, the article evaluates environmental litigation as an emerging regulatory tool in the medium and long term.
