OVERVIEW OF ARTIFICIAL INTELLIGENCE IN THE BRAZILIAN LEGAL SYSTEM: technologies, emerging applications, and regulatory challenges
Artificial Intelligence (AI) has revolutionized various sectors, and the Brazilian legal system is no exception. This article explores the current landscape of AI in the national legal context, analyzing the technologies employed, emerging applications, and the regulatory and ethical challenges that arise. The research addresses the growing digitization of the Judiciary, driven by initiatives such as the Electronic Judicial Process (PJe) and the implementation of AI systems in higher and state courts, such as Victor, Sócrates, Bem-te-vi, Elis, and Sinapses. It discusses the impact of generative AI, such as ChatGPT, on legal practice—from the automation of repetitive tasks to assistance in complex decision-making—and how these tools are reshaping contemporary law practice. In addition, the challenges inherent in the adoption of AI are examined, including issues of algorithmic bias, decision-making opacity, compliance with the General Data Protection Law (LGPD), civil liability, and the urgent need for a robust regulatory framework, such as Bill No. 2,338/2023. The methodology employed consisted of bibliographic and documentary research, focusing on recent publications (2023–2025), relevant legislation, and reports from official bodies. It is concluded that AI represents a powerful tool for improving the efficiency and accessibility of justice, but its implementation requires a cautious and multidisciplinary approach to mitigate risks and ensure equity and legal certainty.
