O ÓBICE NA EFETIVAÇÃO DE DIREITOS SOCIAIS FRENTE À DISCRIMINAÇÃO ALGORÍTMICA NO RECONHECIMENTO FACIAL DE MULHERES NEGRAS

Os avanços tecnológicos que surgiram desde a intensificação da utilização da Inteligência Artificial são incontáveis, da modernização de mecanismos de segurança até a automatização de decisões, a sociedade avança e se torna cada vez mais inteligente e eficiente, ao passo em que avançam também os riscos aos direitos fundamentais, e humanos, das pessoas, que não conseguem optar por fazer parte ou não de tal. Nesse contexto, se torna complexo pensar na efetivação de direitos sociais, quando nem mesmo os direitos fundamentais estão sendo resguardados, na quarta revolução industrial. No presente trabalho, o decote temático escolhido será a abordagem da discriminação algorítmica encontrada nas tecnologias de reconhecimento facial, contra mulheres negras, como uma face do citado problema. Utilizar-se-á do método indutivo-dedutivo, com suporte em pesquisa bibliográfica, no intento de demonstrar a necessidade da busca por uma isonomia racial e de gênero no meio digital, para não fazer padecer no mundo extra-rede a construção jurídico-social pátria.

  • Abstract: The technological advances that emerged since the intensified use of the Artificial Intelligence are uncountable, from the modernization of the safety mechanisms to the automation of decisions, the society advances and becomes increasingly intelligent and efficient, at the same times that the risks to the fundamental and human rights of the people, that aren’t able to choose to be a part of it or not, advances too. Consequently, it becomes complex to think about the realization of social rights, when not even the fundamental rights are being guarded, on the fourth industrial revolution. In this paper, the thematical cutting chosen will be the approach of the algorithm discrimination found on facial recognizing technologies, against black women, as a face of the aforementioned problem. It will use the inductive-deductive method, with support on bibliographical research, in the attempt to demonstrate the need to pursue a racial and gender isonomy on the digital field, to avoid making deep damages to the homeland juridical-social construction on the extra-net world.
