Abstract: This article is situated within the broader context of the constitutionalization of law, a process characterized by the increasing influence of constitutional norms in the creation and application of infraconstitutional legal frameworks. The primary objective of this study is to conceptualize the principle of affectivity within Brazilian family law, considering the impact of civil law constitutionalization. The Federal Constitution played a pivotal role in reshaping legal relationships, allowing for the recognition of new forms of affectivity as a foundation for family entities. To achieve this goal, the study employs a deductive method supported by theoretical research, combined with a qualitative and descriptive approach. Additionally, a bibliographical review was conducted to gather relevant data. The findings indicate a significant influence of constitutional principles on family law, emphasizing that affectivity should not be conflated with emotional affection, given that human emotions cannot be directly apprehended by legal norms and, as such, do not constitute an autonomous source of legal obligation.
