LA ALEGACIÓN DEL “MIEDO INSUPERABLE” EN UN CRIMEN PERPETRADO EN EL CUERPO DE POLICÍA MUNICIPAL.
En casos de sujetos implicados en delitos de sangre, en ocasiones se presentan singulares casuísticas en los que la presunta víctima ejerce el papel inverso de presunto agresor o implicado como cómplice en la perpetración de la infracción.
La casuística que se expone trata de la evaluación psicológica de un sujeto de sexo femenino, implicada como co-autora de presunto asesinato de su pareja afectivo-sentimental pero que, y en aras a su defensa, alegaba miedo insuperable con respecto al otro presunto co-autor (de sexo masculino) e instaurándose ella misma en su rol criminológico de presunta víctima.
La tríada protagonista de dicho crimen trabajaban en el sector de la Policía Municipal de un municipio de más de 1,5 millón de habitantes.
El miedo insuperable que alegaba la informada era motivado por la acción de presunta amenaza que le profería el otro co-autor investigado en la causa y que le referenciaba que iba a causarle daño a sus 2 hijas y a ella misma, si no accedía a las peticiones que le solicitaba y con relación a una reyerta que se ocasionó en el domicilio contra su pareja afectivo-emocional (víctima de asesinato).
Según sentencia, la víctima falleció en el domicilio de la informada y, posteriormente, fue depositado su cuerpo en el maletero de su vehículo siendo trasladado a una montaña cercana y seguidamente, rociado de gasolina e incinerado.
A los pocos días, la Policía localizó los restos del vehículo incinerado y calcinado. Quedaron pocos restos biológicos de la víctima. No obstante, se pudo identificar a la víctima gracias al código existente en un tornillo protésico por el que fue intervenido quirúrgicamente de columna vertebral. Una vez se identifica dicho código, se identificó el nombre y apellidos de la víctima y se inició la instrucción policial de la gente del entorno de esta.

Abstract:
In cases of subjects involved in blood crimes, there are sometimes unique cases in which the alleged victim plays the opposite role of alleged aggressor or involved as an accomplice in the perpetration of the offense.
The casuistry that is exposed deals with the psychological evaluation of a female subject, implicated as co-author of the alleged murder of her affective-sentimental partner but who, and for the sake of her defense, claimed insurmountable fear with respect to the other alleged co-author. -author (male) and establishing herself in her criminological role as alleged victim.
The triad protagonist of said crime worked in the Municipal Police sector of a municipality of more than 1.5 million inhabitants.
The insurmountable fear alleged by the informed was motivated by the action of the alleged threat made by the other co-author investigated in the case and who told her that she was going to cause harm to her 2 daughters and herself, if she did not accede to the requests. that he requested and in relation to a brawl that took place at home against his affective-emotional partner (murder victim).
According to the sentence, the victim died at the home of the informed and, later, her body was deposited in the trunk of her vehicle, being transferred to a nearby mountain and then doused with gasoline and incinerated.
A few days later, the Police located the remains of the incinerated and burned vehicle. Few biological remains of the victim remained. However, the victim could be identified thanks to the existing code in a prosthetic screw for which he underwent spinal surgery. Once said code was identified, the name and surnames of the victim were identified and the police investigation of the people around him began. -
