Abstract: In Mexico, labor and social security rights for domestic workers have historically represented an unresolved issue. Despite playing a crucial role in the economy and the well-being of Mexican families, their rights have not been fully recognized. Even with legislative changes in Mexican law since 2019, these rights have not yet translated into direct benefits for domestic workers or their families. In response to this issue, Mexico has made substantial reforms to labor and social security legislation. The Federal Labor Law (LFT) has formalized rights such as regulated working hours, weekly rest, vacations, vacation bonuses, fair wages, and Christmas bonuses, as well as established norms to prevent discrimination and labor abuse. Regarding social security and affiliation with the Mexican Social Security Institute (IMSS), a pilot program was launched in 2019 for the enrollment of domestic workers in the Mandatory Regime of the IMSS. This program includes medical, hospital, pharmaceutical services, disability benefits, pensions, and childcare. Additionally, in 2024, access to INFONAVIT will be introduced, allowing domestic workers to obtain housing loans. Despite these significant advances in recognizing the rights of domestic workers, the results in terms of implementation and adoption have been modest. It is essential to enhance the oversight of compliance with these regulations to ensure effective social justice for this group of workers.
