COMPROVAÇÃO CIENTÍFICA COMO MARCO DO LIMITE DA DISCRICIONARIEDADE MÉDICA: ANÁLISE A LUZ DA BIOÉTICA E DA SOCIEDADE DO RISCO
In times of pandemic, the search for a cure for patients and the use of mechanisms to prevent deaths is more than natural, but the risks must be considered in order to avoid increasing the damage. With this in mind, this paper seeks to verify the limits of medical discretion in prescribing medication. It argues that prescribing off-label drugs is not the best way to combat the disease, based on the principles of Bioethics and the Risk Society. It is also important to warn medical professionals of the possible civil penalties for prescribing medicines without scientific proof, based on the Theory of Objective Imputation. Therefore, only science, with due observance of the appropriate methods, can point out the best paths, and it is up to science to decide on the tolerated risk.

Abstract:
