SYSTEMATIC BULLYING BY A TEACHER AGAINST MIDDLE SCHOOL STUDENTS IN LIGHT OF HUMAN DIGNITY AND THE TEACHER’S POSSIBLE LIABILITY FOR ABUSE OF RIGHTS ARISING FROM BULLYING

Brazil ratified the Convention on the Rights of the Child on September 24, 1990, incorporating it into the legal system through Decree No. 99,710/1990. That same year, Law No. 8,069 of July 13, 1990 (the Statute of the Child and Adolescent) came into force. Furthermore, Law No. 9,394, of December 20, 1996, establishes the guidelines and foundations of national education, setting forth the duties of teachers. The objective of this study is to examine the possible violation of the rights of children and adolescents in lower secondary education who are bullied by teachers in the classroom. From a methodological standpoint, this study is bibliographic in nature and employs a qualitative approach. As a result, it was found that such practices violate the rights of children and adolescents and the principle of human dignity, as well as potentially subjecting the teacher to civil liability for abuse of rights.
