The Contribution of Judicial Decisions to Legal Certainty and the Development of Compliance Policies in Healthcare Organizations
This final thesis aims to analyze how the stability of judicial decisions contributes to promoting legal certainty in healthcare entities. The research explores how compliance in healthcare, with its key elements—such as regulations and laws, internal policies, training, monitoring, and risk management—influences the actions of healthcare managers and the formulation of protocols based on judicial guidelines. The instability of judicial decisions is discussed in relation to the legal uncertainty it generates and how this can affect the daily practice of physicians and managers. The study also examines the main legal claims in healthcare and their impact on medical practices, patient rights, and public health policies. Methodologically, this research is qualitative and descriptive in nature, involving a study that includes documentary research as well as a literature review. The study’s records were cross-referenced, forming a triangulation of data sources to cross-check them for interpretation, thereby grounding the research. As a result, it is evident that the stability of judicial decisions does indeed have a positive and significant impact on reducing legal disputes and conflicts that may arise; and must be prioritized at all levels of governance and practice, as it makes a crucial and indispensable contribution to ensuring adequate and accessible healthcare for the entire population, regardless of social or economic status, thereby reinforcing social justice and equity.
